Mr.Kleincommentedthataboutayearago,oneofhis l colleaguescomplainedtohimthathewasunabletolookatthe h medicalrecordsinacasebeforethetrial.JudgeDryden  remarkedthatoneoftheideasthathadbeensuggestedtoaddress p  thisproblemwastochangeRule4321,Interrogatoriesto !l" Parties.TheChairinquiredastowhatwouldhappenunderthe "$ revisedlanguageifthedefenseattorneyseesfromtheMideast t$& Indexofprioraccidentrecordsthattheplaintiffhasnumerous  &p!( prioraccidentsresultinginsimilarinjuries.Thedefense '#* attorneysubpoenasallofthepriormedicalrecords.The x)$, plaintiffclaimsthatthepriorrecordshavenothingtodowith $+t&. theaccidentthatisthesubjectofthelitigation.Thedefense, , (0 however,thinksthattherecordsarepertinentbecausetheyshow |.)2 apatternofconductorapriorinjury.Aretheotherrulesand  statutesthatareapplicablesufficienttodealwithissues \ relatingtoPL104191(1996),theHealthInsurancePortability X andAccountabilityAct(_HIPAA_)?JudgeDrydenrespondedthatthis   isthereasononlycounselisallowedaccesstothemedical `  records,becausecounselhasanobligationunder_HIPAA_Ԁtokeep  \  therecordsprivate.     TheChaircommentedthatitiseasytoprovidethatthe d  defenseattorneyisentitledtolookatexhibitsthatthe `  plaintiffintendstointroduce,anditmakesnosensetoprohibit   thedefenseattorneyfromlookingattherecordsuntilthefile h isinthecourtroom.Healsostated_his_Ԁconcernthatproviding d theappropriatereliefdoesnotturntheRuleintoaswordto  allowtheacquisitionofothermaterial. l   JudgeDrydenpointedoutthatifoneisabletoseethe h recordsatthetimeoftrial,thiswouldimpingeon_HIPAA_Ԁanyway.
