Procedures
Memo to the Couple from Clerk Kathy P. Smith

 Civil Ceremonies: are performed Monday Through Friday, 9:00 a.m. to 4:00 p.m. at the Calvert County Courthouse. The fee is $25.00, paid by either cash or money order immediately prior to the ceremony. Appointments for civil ceremonies may be made by calling the Clerk’s office at 410-535-1600 ext. 2269 or 301-855-1243 ext. 2269 during working hours. Ceremonies are performed in space available and courtrooms may not be scheduled in advance. Many beautiful weddings have taken place on the Courthouse lawn, weather permitted.

Procedures: Application may be made Monday through Friday, 8:30 am to 4:30 pm at the office of the Clerk of Circuit Court. (If it is not convenient to visit the Clerk's Office in the county where the marriage is to take place, you may apply for a license using a Non-Resident Affidavit form.)  This form must be taken to the Clerk of the Circuit Court or comparable official where you reside. A "comparable official" would be the public official in the State, County, or Province where you reside who issues marriage licenses or performs the same duties as the Clerk of Circuit Court in Maryland.  A notary public's affidavit is not sufficent, since that official, although a public officer, does not perform the same duties and is not comparable to a Clerk of Court in Maryland.

Take the Non-Resident Application Form to your local official who issues Marriage Licenses and provide them with a copy of the instructions.

Bride or Groom must appear in person and give, under oath, the following information:

1. Full name of each party

2. Place of residence of each party

3. The age of each party

4. Whether the parties are related by blood or marriage and, if so, in which degree of the relationship

5. The marital status of each party: Single (never married), Divorced or Widowed

6. The date and place of EACH death or judicial determination that ended any former marriage. (Bring divorce decrees, death certificates or court orders from ALL previous marriages)

7.  Social Security numbers of each party.  Social Security numbers will not appear on the license and are not part of the public record to be disclosed, except to the State Child Support Enforcement Administration or a person of interest. 

Applicant must present photo identification and sign application.

A license fee of $55.00 must be paid by either CASH orMONEY ORDER at the time of application. NO REFUNDS.

An individual 16 or 17 years old may not marry unless:

1. The individual has the consent of a parent or guardian and the parent makes oath that the individual is at least 16 years old or:

2. If the individual does not have the consent of a parent or guardian, either party to be married gives the clerk a certificate from a licensed physician stating that the physician has examined the woman to be married and has found that she is pregnant or has given birth to a child.

An individual 15 years old may not marry unless:

1. The individual has the consent of a parent or guardian AND

2. Either party to be married gives the clerk a certificate from a licensed physician stating that the physician has examined the woman to be married and has found that she is pregnant or has given birth to a child.

An individual under the age of 15 MAY NOT MARRY

At the time of application, the marriage license will be issued. HOWEVER, the license may not be used prior to the effective date, which is 6:00 a.m. on the second calendar date after issuance. The license must be used within 6 months of the effective date. Replacement licenses may be obtained, during the 6 month period the original license is valid, for a fee of $10.00.

To the Couple:

Congratulations on your decision to get married! At the time of application, you received your marriage license. However the license may not be used prior to the effective date, which is 6:00 am. on the second calendar date after issuance. You have six (6) months from the effective date in which to use the marriage license before it expires. You must be married in the county where your license was purchased. Replacement licenses maybe obtained, during the six (6) month period the original license is valid, for a fee of $10.00. Prior to your marriage, take the marriage license and these instructions to your clergy. The minister will complete all information and give the completed marriage license to you after the ceremony.  Best wishes for a successful life together!

To the Minister

Before performing the ceremony, please check the effective date. The license may not be used prior to the effective date, which is 6:00 am. on the second calendar date after issuance and must be used within six (6) months of the effective date. The couple must be married in the county where their license was purchased.

Before giving the marriage license to the newly married couple, please complete the following:

(1) Date of the ceremony and City or Town that the ceremony was performed in;

(2) Your Signature;

(3) Your title and office; and

(4) Mailing address (please include street and city).

Give the top copy to the couple. This is their original. Complete and sign the green copy, returning it to the Clerk’s Office in the envelope provided no later than five (5) days after the ceremony is completed. Please provide the printed name of the minister and a phone number in the event further clarification is necessary. (A business card is perfect!). Finally, keep the white copy for your records.

The Bride's and Groom's social security numbers are optional and were requested of the couple at the time of application. You do not need to request this information again.
